1) Scope of Application 1.1 These Terms and Conditions apply to all contracts concluded between the customer and the seller regarding the products offered in the HeatEyeMask online shop. 1.2 A customer is any natural person or legal entity who enters into a purchase contract. 1.3 Any conflicting terms of the customer are not recognized unless expressly agreed upon.
2) Conclusion of Contract 2.1 Product listings in the online shop do not constitute binding offers but an invitation for the customer to place an order. 2.2 By completing the order process, the customer submits a binding offer. 2.3 The contract is concluded when the seller accepts the order via order confirmation, shipment of goods, or payment request within five days.
3) Right of Withdrawal 3.1 Consumers may be entitled to a statutory right of withdrawal depending on applicable laws. 3.2 Detailed information is provided in the seller's separate Return & Refund Policy. 3.3 For customers outside the European Union, different consumer protection laws may apply, which may limit or exclude withdrawal rights.
4) Prices and Payment Terms 4.1 All prices are final prices unless stated otherwise. 4.2 Additional costs such as customs duties or international fees may apply and are the responsibility of the customer. 4.3 Available payment methods are shown during checkout. 4.4 Payment processing may be handled by third-party providers such as PayPal or Shopify Payments, subject to their terms.
5) Delivery and Shipping Conditions 5.1 Delivery is made to the address provided by the customer. 5.2 Estimated delivery times are generally 6–14 business days, depending on destination and external factors. 5.3 Processing time is typically 1–2 business days. 5.4 Delays may occur due to customs, shipping carriers, or other external circumstances beyond our control. 5.5 Shipping is free of charge unless otherwise stated.
6) Retention of Title Goods remain the property of HeatEyeMask until full payment has been received.
7) Warranty (Liability for Defects) Statutory warranty rights apply where applicable. For business customers, warranty periods may be limited according to applicable law.
8) Liability The seller is fully liable in cases of intent, gross negligence, injury to life or health, or mandatory statutory provisions. In other cases, liability is limited to foreseeable damages.
9) Applicable Law 9.1 These Terms shall be governed by the laws applicable to the seller's business operations, excluding the UN Convention on Contracts for the International Sale of Goods. 9.2 For consumers, mandatory legal protections of their country of residence may still apply.
10) Alternative Dispute Resolution The seller is not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
